Nondiscrimination rules apply to health contingent

− Opportunity to qualify once/year
− Must offer alternative means of qualifying
− Outcome-based programs must offer reasonable alternative
Individual Mandate and

Rule for individuals: have health insurance coverage
by 1/1/14 or else (pay a penalty)
Penalty applies to taxpayers and their children who
don’t have “minimum essential coverage”

fewer during the calendar year and
(2) the employees in excess of 50 employed
during that period were seasonal workers
